Further, the judge allowed Ferdinand Waititu to be granted the application in the event that the Director of Public prosecution, Renson Ingonga, had interest in the case.
The former Kiambu Governor, Ferdinand Waititu, has been offered a chance to amend his application. Mr. Ferdinand seeks to be freed on bond. Therefore, this comes after High Court judge Lucy Njuguna made the ruling. The ruling merited Waititu’s bid to renew his application.
The judge said, “I have perused the draft appeal and in my considered view, the amendments are material for proper determination of this appeal.”
Ferdinand Waititu Corruption Case
Mr. Waititu had been sentenced to 12 years’ imprisonment for graft. Alternatively, Waititu had a chance to pay a fine of Sh53.5 million. Waititu had received kickbacks of sh25.6 million from a road contractor during his tenure as governor.
Recently, Mr. Waititu had applied to be freed on bond, but he did not succeed. The court had ruled that the case would be expedited. Justice Njuguna had denied the medical grounds brought by Mr. Waititu. He claimed that the medical reports did not meet the threshold for the court to grant Waititu bail.
Additionally, the judge emphasized that Mr. Waititu could access the medical facilities in prison. As the Judge rejected the application, he argued that a fresh application had already been done without court permission. Moreover, the bid for his release had already been decided.
“I find that the application has merit and is allowed,” the Judge stated. Also, he advised Mr. Waititu to file a petition two days after the ruling. The former Governor had been convicted since February 14 by anti-corruption chief magistrate Thomas Nzyoki.
